Victims' Rights
- The rights of sexual assault victims should be recognized, supported and enforced.
- Victims have the right to be treated with dignity, respect, understanding and empathy.
- Victims have the right to be free from threats, intimidation, coercion and harassment.
- Victims have the right to be kept informed on every step of the investigation and prosecution.
- Victims have the right to express a preference regarding prosecution.
- Victims have the right to be treated with impartiality.
- The safety and welfare of the victim should always be top priority.
- The victim has the right to prompt medical and/or psychological care.
- The victim has the right to request an investigator based on cultural, physical, language and gender issues.
- Victims have the right to privacy and confidentiality.
- Victims have the right to be informed about victim rights and services in the criminal justice system including victim compensation.
- Victims have the right to be heard and present in court proceedings.
- Victims have the right to request the presence of a victim advocate during the forensic medical examination. An advocate from a certified rape crisis center shall be permitted to attend any forensic medical examination.
- No law enforcement officer, prosecuting attorney or government official shall ask or require a victim of a sexual offense to submit to a polygraph examination or other truth-telling device as a condition of the investigation.
